ARTICLE 01

General Provisions & Purpose

These terms establish the conditions for using the Bear Spray Rental Service ("Service") provided by Bear Guard ("We/Us"). By using this Service, the user agrees to these terms. This product is a supplementary device to reduce the risk of bear encounters during hiking or camping and does not guarantee complete safety.

ARTICLE 02

Rental Period and Extension

• The rental period is from the scheduled arrival date (day before use) to the return shipping date (day after use).
• If the return is delayed, you must contact us in advance. A late fee of 500 JPY per can per day will be charged for any delay, regardless of prior notice.

ARTICLE 03

Payment & Cancellation Policy

Payment must be made in advance via "PayPal (Credit Card)". Please pay by the due date stated in the invoice email sent after you submit the booking form.

Cancellation Fees:

• Before Shipping (Up to 4 days before start date): Free (Refunded minus transaction/bank fees)
• After Shipping: 100% of the rental fee (Non-refundable)

ARTICLE 04

Delivery Area & Conditions

This service is strictly limited to the "Honshu" (Mainland Japan) area. Delivery to Hokkaido, Shikoku, Kyushu, Okinawa, and remote islands is prohibited by aviation law and shipping company regulations (hazardous materials).

Important Delivery Rule (No Airbnb):

We can ONLY deliver to hotels that have a front desk. Delivery to Airbnb, Minshuku (traditional guesthouses), or private residences is strictly PROHIBITED.

Important Return Rule:

When returning the item, you MUST specify "Ground Shipping (陸送)" and ship from a convenience store or Yamato Transport office. Air transport is strictly prohibited by law.

ARTICLE 05

Product Management & Prohibited Acts

Users must manage the product with the care of a good manager. The following acts are prohibited:

• Using it for purposes other than bear deterrence (e.g., against people, objects, pranks)
• Subleasing, transferring, or pawning the product
• Disassembling or modifying the product

ARTICLE 06

Compensation for Use, Loss, or Damage

In the following cases, we will charge the following costs in addition to the rental fee:

• If sprayed/used:
  Regardless of the reason (bear encounter, accidental discharge), a flat fee of 8,000 JPY will be charged as the product replacement cost. Note: If the weight of the returned can is reduced by 15% or more, it will be strictly considered "used".
• Loss, theft, or total damage:
  The current market value of the product will be charged.
• Loss or damage of the safety pin:
  Since it cannot be reused, the same amount as if used (8,000 JPY) may be charged.

ARTICLE 07

Disclaimer

We shall not be liable for any damages (injuries, accidents, mental distress, etc.) arising from the use or inability to use this product, except in cases of intent or gross negligence on our part. The user acknowledges that the effectiveness of this product varies depending on weather conditions and individual bears.
